Terms and Conditions

Offer

All our offers, sales, and deliveries are subject exclusively to the following terms and conditions, even if no explicit reference is made to them. By placing an order, these terms are deemed accepted. Any amendments to these terms must be made in writing. Verbal or telephone agreements shall only become legally valid once confirmed by us in writing. All our offers, whether written, verbal, or by telephone, are non-binding unless expressly stated otherwise. The latest offer supersedes all previous offers.

Order

Orders shall be deemed accepted once confirmed by us in writing or upon issuance of an invoice. If one of the listed items is unavailable, we reserve the right to supply an equivalent item of the same brand in a different color. In such a case, however, you have the right to withdraw from your order. We are entitled to request securities or withdraw from the contract if the buyer’s creditworthiness appears uncertain.

Delivery

Unless otherwise agreed, delivery shall be made free domicile by a transport company or forwarding agent appointed by us.

Delivery Time

The delivery period is up to 14 days after the order has been placed. In the event of delayed delivery or non-delivery, the buyer shall not be entitled to claim damages or withdraw from the contract. In the event of unforeseen circumstances, we reserve the right to extend the delivery period or withdraw from the contract.

Retention of Title

The delivered goods shall remain our property until full payment of all claims arising from the delivery has been received. The customer may only dispose of goods subject to retention of title within the ordinary course of business. In particular, such goods may neither be pledged nor transferred as security. Third parties must be informed of our ownership rights. The buyer is obliged to notify us immediately of any access by third parties to the goods.

Liability for Defects

The buyer is obliged to inspect the delivered goods immediately upon receipt for any defects and completeness. Damages and losses must be confirmed in writing. We guarantee full compensation for damages and impairments occurring during transport, provided that the defects have been properly confirmed.

Prices, Discounts, and Special Offers

Prices are quoted in euros per product and exclude all statutory duties and taxes. We reserve the right to change prices without prior notice. Larger orders result in lower costs for us; therefore, we pass these savings on to you in the form of individual quantity discounts.

Payment

Unless otherwise agreed, payment for our deliveries is due immediately upon receipt of the invoice and shall be transferred to our account at Act Bank – Bank Austria, bank code 99000, account number 100007942.

For payments made within 14 days of receipt of the invoice, we grant a 2% cash discount. Our standard payment term is 30 days from the invoice date.

Late Payment

In the event of late payment, the buyer undertakes to reimburse all costs, expenses, and cash outlays incurred by the contractual partner in pursuing legitimate claims arising from this contractual relationship, including in particular the statutory costs of debt collection agencies or legal counsel.

In case of default, default interest at a rate of 1% per month above the respective discount rate of the Austrian National Bank shall be charged from the date the payment became overdue.

Final Provisions

Unless otherwise agreed, the statutory provisions applicable between fully qualified merchants shall apply. The seller’s registered office shall be the place of performance and jurisdiction for all rights and obligations arising from the business relationship.
